Policy statement on the use of chain saws: The Friends of the Kayaderosseras does not permit the use of chain saws at any official event or project of the organization.
Background: Because of concern for the safety of our members, and the possibility of polluting the creek with gasoline or oil, Friends of the Kayaderosseras does not permit the use of chain saws at its official* functions. FoK recognizes that the use of chain saws would be desirable from the perspective of increasing recreational use of the creek by keeping it open for paddling. However, other considerations include maintaining fallen tree trunks and branches under water because they serve as valuable aquatic habitat. There are practical and legal limitations to our ability to physically change the creek’s natural character. Hand tools are allowed at FoK events and may be used to create small surface-level openings for the passage of canoes. Any blockage too large for hand tools should be referred to the NYS Department of Environmental Conservation, which has the statutory authority over human-caused stream disturbances.
Individuals who wish to use chain saws in the creek at times other than official FoK functions should recognize that they are acting as individuals and not as members of Friends of the Kayaderosseras, and that they assume personal responsibility for their safety and the safety of those working in the same area, and for any potential liability resulting from their actions.
*An official function is any event or project conducted in the name of the Friends of the Kayaderosseras and approved by its board of directors.
Policy on Official Functions: All official functions (meetings, workdays, etc.) of Friends of the Kayaderosseras must be approved in advance of their occurrence. Approval must be by formal motion by the Board of Directors following the procedures described in the By-laws. Approval of official functions shall be included in the minutes of the Board of Directors meeting at which the approval occurred, and these minutes shall serve as the official record of approval. Members of Friends of the Kayaderosseras attending officially approved functions are covered by the organization’s liability insurance. Members and non-members conducting activities not approved by the Board of Directors are acting as individuals and assume their own liability. This policy applies to functions that are open to the general membership and/or to potential new members. It is not intended to limit the ability of Friends of the Kayaderosseras Park Stewards to solicit help on an ad hoc basis for routine park maintenance from members who have volunteered for such tasks, nor does it limit the ability of duly constituted Committees to hold meetings at their discretion. Such activities are a part of the normal activity of Friends of the Kayaderosseras and do not require specific Board approval.
Conflict of Interest Policy: Members of the Board of Directors of the Friends of the Kayaderosseras should avoid conflicts of interest between the organization and the individual’s personal, professional, and business interests. This policy includes avoidance and disclosure of actual conflicts of interest and the perception of conflicts of interest.
